Privacy Policy

This Section 1 is intended to provide a concise notice at or before the point at which we collect Personal Information, including for purposes of applicable U.S. state privacy laws. The categories below reflect the Personal Information we reasonably expect to collect in connection with the Services. We retain each category only for as long as reasonably necessary and proportionate to achieve the purposes described below, including to fulfill a request, maintain consent and compliance records, administer contractor relationships, prevent fraud, resolve disputes, and satisfy legal, accounting, security, and recordkeeping obligations.

1.1 Categories of Personal Information Collected.

• Identifiers and Contact Information, such as name, e-mail address, telephone number, mailing or service address, ZIP code, and similar identifiers or contact details;
• Project and Commercial Information, such as the type of home-improvement project, trade, scope, location, timing, budget- or estimate-related information, answers submitted through the quote funnel, match status, and related transaction or lead information;
• Internet, Device, and Usage Information, such as IP address, browser and device type, operating system, referring source, page URLs, pages viewed, timestamps, advertising or cookie identifiers, and interactions with the Website and quote funnel;
• Consent, Preference, and Communications Records, such as cookie choices, opt-out requests, consent status, the date/time and version of consent or disclosure language presented, communications with us or a matched Contractor, and related compliance records;
• Contractor and Business Information, such as business name, representative contact information, service areas, trades, license and insurance information or status, business standing, application information, lead preferences, portal activity, invoices, payment status, and related business records; and
• Derived, Inferred, and De-Identified Information, such as information derived from the foregoing to detect duplicates or fraud, understand funnel performance, measure advertising effectiveness, and generate aggregate or de-identified analytics.

1.2 Purposes of Collection and Use. We collect and use the foregoing categories to operate and provide the Services; process and respond to quote and match requests; identify Contractors that service a requested trade and location; display limited masked project details to potentially eligible Contractors so one may accept the request; disclose direct contact information to the one Contractor that accepts and is matched to the request; communicate match and status information; administer Contractor applications, verification, portal access, billing, and lead activity; maintain site functionality and preferences; detect fraud, invalid submissions, duplicates, and security incidents; conduct analytics; measure, attribute, and optimize advertising; comply with law; enforce our agreements; and otherwise process Personal Information as described in this Privacy Policy or with your direction or consent.

1.3 Sale, Sharing, and Targeted Advertising. We do not sell Personal Information to data brokers for their independent resale. However, certain disclosures described in this Privacy Policy may be considered a “sale,” “sharing,” “targeted advertising,” “cross-context behavioral advertising,” or similar activity under one or more U.S. state privacy laws. For example, HomeQuotely may receive certain compensation from the Contractor that accepts an exclusive lead, and we may disclose certain online activity information or hashed identifiers to advertising partners for advertising measurement, attribution, matching, optimization, or related purposes. Whether a particular disclosure falls within a statutory definition depends on the applicable law and the circumstances, including statutory exclusions for disclosures made at a consumer’s direction, to fulfill a service requested by the consumer, or solely to measure advertising performance.

Where applicable, you may opt out of covered sale, sharing, or targeted advertising through our Do Not Sell or Share My Personal Information page, our Cookie Policy and preference controls, or a recognized browser-based opt-out preference signal as described below.

1.4 Sensitive Personal Information. The Services are not designed to collect Social Security numbers, financial account credentials, precise geolocation, health or medical information, biometric data, or other information that is treated as sensitive Personal Information under applicable privacy laws. Please do not submit such information through free-text fields or communications unless we specifically request it for a disclosed purpose and are legally permitted to process it.

We may collect Personal Information through the following sources:

• Directly from you, including when you use the quote funnel, request a match, communicate with us, exercise a privacy choice, apply as a Contractor, or use Contractor portal functionality;
• Automatically from your browser or device when you access or interact with the Services, including through cookies, local storage, pixels, tags, log files, and similar technologies;
• From Contractors, service providers, analytics and advertising partners, communications providers, compliance vendors, and other parties that assist us in operating or measuring the Services; and
• From public and commercially available sources, including business directories, contractor licensing or insurance sources, public websites, and publicly available business contact information used to identify or evaluate prospective Contractors.

3.1 Homeowners and Visitors.

• Contact and Identifying Information, including name, e-mail address, telephone number, ZIP code, service address, and any other contact information you provide;
• Project Information, including the home-improvement category, scope, timing, location, and other answers or information submitted in the quote or estimate flow;
• Usage and Device Information, including IP address, browser type, device type, operating system, referring URL or source, page URL, pages viewed, session information, timestamps, and other interactions with the Website;
• Advertising and Measurement Information, including ad click or campaign identifiers, cookie or pixel identifiers, conversion events, and other data used to attribute or measure advertising;
• Consent and Preference Information, including cookie choices, Global Privacy Control or other opt-out preference signals received, consent records, timestamps, versions of disclosures shown, opt-out or suppression records, and communications preferences; and
• Communications, including the content and metadata of communications you send to us and records of communications regarding your request, match, privacy rights, or other support matters.

3.2 Contractors and Contractor Representatives.

• Business and Contact Information, including business name, representative name, telephone number, e-mail address, service area, trades, and other application information;
• Qualification Information, including licensing, insurance, business standing, and related verification information;
• Account and Portal Information, including login or account information, lead preferences, territory, trade selections, portal activity, lead previews and acceptances, and related records;
• Billing and Transaction Information, including lead charges, invoices, credits, payment status, and related billing records. Payment information may be processed by financial institutions or payment providers rather than stored directly by HomeQuotely;
• Communications and Consent Information, including telephone, text, and e-mail communications, scheduling records, and consent or opt-out records; and
• Usage and Device Information, including IP address, browser/device information, and usage logs associated with access to the Website or Contractor portal.

3.3 Information from Other Sources. We may receive information from advertising or analytics providers about campaign interactions and conversions; from service providers that support communications, hosting, fraud prevention, or compliance; and from public or commercially available sources used to identify or verify Contractors. We may combine information from these sources with information we collect directly, subject to applicable law and your privacy choices.

• Provide, operate, maintain, and improve the Services and Website;
• Generate or display informational estimates, cost information, or quote-request results;
• Match Homeowners with Contractors based on requested trade, location, availability, and related criteria;
• Present masked project details to eligible Contractors and provide direct contact and project information to the one Contractor that accepts and is matched to the request;
• Notify a Homeowner of the identity of a matched Contractor and facilitate project-specific communications;
• Process Contractor applications, verify qualifications, administer Contractor accounts or portal functionality, and manage lead charges, invoices, credits, or payment status;
• Authenticate Users, preserve quote-funnel progress, remember settings, and provide requested functionality;
• Detect, investigate, and prevent fraud, duplicate or invalid submissions, abuse, security incidents, and violations of our agreements;
• Analyze Website usage, quote-funnel performance, and service effectiveness;
• Measure, attribute, and optimize our advertising and marketing campaigns, subject to applicable privacy choices;
• Maintain records of disclosures, consents, opt-outs, and other compliance activities;
• Communicate with you regarding requests, matches, applications, support, transactions, policy updates, or other service-related matters;
• Send marketing or promotional communications where permitted by law and consistent with any consent or preferences you have provided;
• Comply with legal obligations, respond to lawful requests, establish or defend legal claims, and protect the rights, property, safety, and security of HomeQuotely, Users, and others; and
• Carry out any other purpose described when the information is collected, as otherwise permitted by law, or with your consent or direction.

We and our service providers and partners may use cookies, local storage, pixels, tags, web beacons, JavaScript, device identifiers, and similar technologies to operate the Website, preserve quote-funnel progress, remember preferences, understand Website use, detect fraud, and measure or optimize advertising. Some technologies are strictly necessary for the Website to function; others are optional and are controlled through our cookie consent and preference tools.

Non-essential technologies should operate consistently with the choices expressed through our cookie banner and preference center. Our Cookie Policy provides additional information about the categories of technologies we use, the purposes for which they are used, and how to manage them.

6.1 Online Advertising and Measurement. We may use advertising and analytics technologies, including technologies provided by Google and Nextdoor, to understand how Users reach the Website, measure whether advertising results in a completed quote request or other conversion, attribute conversions to advertising interactions, evaluate campaign effectiveness, and improve bidding or campaign performance. Depending on your settings and the technology involved, these partners may receive information such as IP address, browser and device information, page URLs, referring information, advertising or cookie identifiers, timestamps, and conversion-event information.

6.2 Hashed Contact Identifiers. If we enable enhanced conversion or advanced matching functionality and your applicable privacy choices permit it, we may normalize and cryptographically hash certain first-party contact information, such as an e-mail address or telephone number, using SHA-256 or a comparable one-way hashing method and provide the resulting hashed identifier to an advertising partner. The partner may compare that hashed value to hashed identifiers associated with its own users or accounts to determine whether an advertising interaction resulted in a conversion and to support related measurement or optimization. Hashing is a security measure; because a participating platform may be able to match a hashed identifier to information it already maintains, we do not treat hashed contact identifiers as anonymous or de-identified information for purposes of this Privacy Policy.

6.3 Privacy Choices for Advertising. To the extent these activities are treated as a sale, sharing, targeted advertising, cross-context behavioral advertising, or similar regulated processing under applicable law, we provide the opt-out mechanisms described in Sections 8 and 9 below. We configure enhanced matching and other non-essential advertising technologies so that covered Personal Information is not transmitted when an applicable opt-out preference is in effect. Our use of advertising measurement data is separate from consent to telephone calls, text messages, or e-mails; consent to communications is governed by the specific disclosure or authorization presented in connection with those communications.

7.1 Contractor Matching. HomeQuotely’s core service is to connect a Homeowner’s project request with one Contractor. Before a Contractor accepts a lead, we may display limited or masked project information (for example, trade, general location, and project details) to Contractors that appear eligible for the request so they can determine whether to accept it. We withhold the Homeowner’s direct contact information from those Contractors at that stage. Once one Contractor accepts and is matched to the request, we may provide that Contractor with the Homeowner’s name, telephone number, e-mail address, service location, and project details so the Contractor can respond to the specific project requested. We do not provide the same Homeowner contact lead to multiple Contractors for the same request as part of our ordinary matching model.

Contractors are independent third parties and not our service providers with respect to the home-improvement services they offer. Their handling of Personal Information after a match may be subject to their own privacy practices and legal obligations. HomeQuotely may receive compensation from a Contractor for an accepted lead. As described above, applicable privacy laws differ as to whether a consumer-directed or requested-service disclosure, or a disclosure made for valuable consideration, constitutes a “sale” or “sharing.”

7.2 Service Providers and Processors. We may disclose Personal Information to vendors and service providers that perform functions on our behalf, such as website hosting, cloud infrastructure, analytics, communications, consent and preference management, fraud and security services, Contractor verification, customer support, billing, accounting, legal services, and compliance recordkeeping. We seek to use contractual and other safeguards appropriate to the nature of the services and information involved.

7.3 Advertising and Analytics Partners. Subject to applicable law and privacy choices, we may disclose online identifiers, device and usage information, advertising interaction information, conversion-event information, and, if enabled, hashed contact identifiers to advertising and analytics partners, including Google and Nextdoor, for measurement, attribution, matching, optimization, analytics, and related advertising services. Such disclosures may be considered a sale, sharing, or targeted advertising under certain state privacy laws even where we do not receive money in exchange for the information.

7.4 Legal, Safety, and Enforcement Purposes. We may disclose Personal Information where we believe in good faith that disclosure is reasonably necessary to comply with applicable law, regulation, legal process, or governmental request; enforce our terms or agreements; detect, investigate, or prevent fraud, security incidents, or unlawful activity; or protect the rights, property, safety, or security of HomeQuotely, Users, or others.

7.5 Business Transactions. We may disclose or transfer Personal Information in connection with an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to applicable law.

7.6 At Your Direction or With Your Consent. We may disclose Personal Information to other parties when you direct us to do so, when disclosure is reasonably necessary to provide a service you specifically request, or when you otherwise consent to the disclosure.

7.7 Aggregate and De-Identified Information. We may create and use aggregate or de-identified information that cannot reasonably be linked to an identified or identifiable individual or household. Where required by law, we will maintain such information in de-identified form and will not attempt to re-identify it except as permitted to test whether our de-identification processes are effective or as otherwise permitted by law.

7.8 Text Messaging Consent Data. To the extent we operate text-message programs, originator opt-in data and consent records are not shared with unaffiliated third parties for those third parties’ independent marketing or promotional purposes. We may provide such information to messaging aggregators, telecommunications providers, platform providers, and other vendors as necessary to deliver, administer, secure, and document the applicable messaging program, and as otherwise required by law.

Certain U.S. state privacy laws provide eligible residents with a right to opt out of the sale of Personal Information, the sharing of Personal Information for cross-context behavioral advertising, or processing for targeted advertising. Because the definitions and statutory exclusions vary by state, a disclosure described in this Privacy Policy may be regulated in one jurisdiction but excluded in another.

We provide a centralized method to exercise these rights. An opt-out applies prospectively to covered activities associated with the information or browser/device we can reasonably identify from the request. It does not undo a disclosure that lawfully occurred before the opt-out was received. An opt-out also does not prevent disclosures to service providers acting on our behalf or other disclosures that are not treated as a sale, sharing, or targeted advertising under the applicable law.

To exercise an applicable opt-out right, use our Do Not Sell or Share My Personal Information page or adjust your Cookie Policy and preference controls.

Where required by applicable law, we recognize and process supported, user-enabled browser- or device-based opt-out preference signals, including Global Privacy Control (“GPC”), as a request to opt out of covered sale, sharing, or targeted advertising for the browser or device from which the signal is sent and, where we can reasonably associate the signal with an identifiable consumer profile, for that profile as required by law. We do not treat a signal that is enabled by default without an affirmative consumer choice as a valid universal opt-out mechanism where applicable law requires an affirmative user choice. Legacy “Do Not Track” signals that do not communicate a legally recognized opt-out preference may not be recognized.

Depending on your state of residence and whether an applicable law applies to HomeQuotely, you may have one or more of the following rights, subject to statutory limitations and exceptions:

• confirm whether we process your Personal Information and access or obtain a copy of it;
• request correction of inaccurate Personal Information;
• request deletion of Personal Information;
• obtain certain Personal Information in a portable format;
• obtain information about categories of Personal Information, purposes of processing, or categories or specific identities of third parties to which information was disclosed, where required;
• opt out of sale, sharing, targeted advertising, or certain profiling;
• limit certain uses or disclosures of sensitive Personal Information, where applicable;
• appeal a decision we make concerning a privacy request, where applicable; and
• exercise privacy rights without unlawful discrimination or retaliation.

You may also manage non-essential cookies through our preference controls; unsubscribe from promotional e-mails by using the unsubscribe mechanism included in those messages; and revoke or withdraw consent to project-related communications as described in the applicable consent disclosure, Terms of Service, or communication. We may continue to send non-promotional communications that are necessary to administer a request, transaction, legal obligation, or account even if you opt out of marketing communications.

For access, deletion, correction, portability, or similar requests, we may take reasonable steps to verify that the request relates to you before responding, using information appropriate to the nature of the request and the sensitivity of the information involved. We will not require more information than reasonably necessary for verification. Requests to opt out of sale or sharing generally will not be subject to identity verification where applicable law prohibits or limits verification, although we may request information reasonably necessary to identify the Personal Information, browser, device, or preference to which the request relates.

We generally respond to verified consumer rights requests within forty-five (45) days or such other period required by applicable law, subject to any lawful extension. Opt-out requests are implemented within the time required by applicable law. If we deny a request, in whole or in part, we will provide the information required by applicable law and, where applicable, instructions for submitting an appeal.

11.1 Authorized Agents. Where permitted by law, you may designate an authorized agent to submit a privacy request on your behalf. We may request evidence of the agent’s authority and may require you to verify your identity directly with us unless applicable law provides otherwise. For recognized universal opt-out signals, we will process the signal in accordance with applicable law without requiring a separate agent authorization where the law treats the signal itself as an authorized request.

11.2 Non-Discrimination. We will not unlawfully discriminate against you for exercising a privacy right. However, a privacy choice may affect functionality where the Personal Information or processing at issue is reasonably necessary to provide a feature or service you request. For example, we cannot provide a Contractor with your telephone number while simultaneously withholding that telephone number from the Contractor if you affirmatively request and authorize that specific disclosure as part of a new match request.

We retain Personal Information for no longer than reasonably necessary and proportionate to accomplish the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. The criteria we use include the duration of the User relationship or request; the time needed to complete a match or Contractor transaction; the need to maintain consent, suppression, lead, invoice, fraud-prevention, and compliance records; applicable statutes of limitation; legal, tax, accounting, and regulatory requirements; dispute-resolution needs; and security or business-continuity considerations. Cookie and similar technology retention varies by technology and may be session-based or persistent; additional information is provided in our Cookie Policy or preference tool where available.

We maintain administrative, technical, and organizational safeguards that we consider reasonable and appropriate to the nature of the Personal Information we process. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

The Services are intended for adults and are not directed to children. You must be at least eighteen (18) years old to submit a project request or use the Services as a Homeowner or Contractor. We do not knowingly collect Personal Information from children under thirteen (13), and we do not knowingly sell or share Personal Information of consumers under sixteen (16) where applicable law requires affirmative authorization. If you believe a child has provided Personal Information to us, contact us using the information below.

The Services may contain links to websites, applications, or services operated by third parties, including Contractors and advertising or technology providers. This Privacy Policy does not govern the privacy practices of third parties when they act independently of HomeQuotely. We encourage you to review their privacy notices before providing Personal Information directly to them.

HomeQuotely is operated in the United States. If you access the Services from outside the United States, your information may be transferred to, stored in, or processed in the United States or other jurisdictions where our service providers operate. The Services are not presently directed to residents of jurisdictions outside the United States where additional localized privacy notices or transfer mechanisms would be required unless expressly stated otherwise.

We may update this Privacy Policy from time to time to reflect changes in our Services, technology, legal requirements, or data practices. We will post the revised Privacy Policy on the Website and update the “Last Updated” date above. Where required by law, we will provide additional notice or obtain consent before a material change takes effect.

This Exhibit A supplements the Privacy Policy and is intended to address requirements of comprehensive or sector-specific U.S. state consumer privacy laws that may apply to HomeQuotely. The rights described below apply only to the extent the applicable law covers HomeQuotely, the individual, and the relevant Personal Information or processing activity. Statutory exemptions and exceptions may apply. Capitalized terms not defined in this Exhibit have the meanings given in the Privacy Policy.

Unless otherwise stated below, eligible residents may submit requests using the methods described in Section 11 of the Privacy Policy. We may verify requests and process authorized-agent or appeal requests as permitted or required by applicable law. We will not unlawfully discriminate against a consumer for exercising a protected privacy right.

Additional Information for California Residents

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), applies to HomeQuotely and to your Personal Information, California law may provide you with rights to know/access, delete, correct, and receive certain Personal Information, to opt out of the sale or sharing of Personal Information, to limit certain uses or disclosures of sensitive Personal Information where applicable, and to be free from unlawful discrimination for exercising those rights.

During the preceding twelve (12) months, we may have collected the categories described in Section 1.1 of the Privacy Policy, including identifiers; commercial/project information; internet or other electronic network activity information; geolocation at an approximate level; professional or employment-related business information for Contractors; and inferences or derived information. We collect and use these categories for the purposes described in Sections 1.2 and 4 and disclose them to the categories of recipients described in Section 7. We do not knowingly collect sensitive Personal Information for purposes outside those permitted without a right to limit, and we do not knowingly sell or share Personal Information of consumers under sixteen (16) years of age.

We do not sell Personal Information to data brokers for their independent resale. However, our transfer of an accepted lead to a matched Contractor for consideration may constitute a “sale” under the CCPA, and our use of certain advertising technologies may constitute a “sale” and/or “sharing,” depending on the facts and statutory exceptions. Categories potentially sold or shared may include identifiers, internet or electronic network activity information, and commercial/project information, and the recipients may include matched Contractors and advertising or analytics partners. California consumers may opt out using our Do Not Sell or Share My Personal Information page, cookie preference controls, or a valid Global Privacy Control signal. We do not require identity verification to process an opt-out request beyond what is reasonably necessary to identify the information or preference to which the request relates.

A California consumer may designate an authorized agent to submit a request. We may require reasonable proof of the agent’s authority and, for requests other than opt-out requests, may also ask the consumer to verify identity directly as permitted by law. California consumers may also request the categories of Personal Information disclosed for business purposes and the categories of recipients, as required by law.

If the Colorado Privacy Act applies to HomeQuotely and to your Personal Information, eligible Colorado residents may have the right to:
